Terms of Service

Welcome to OutPack. These Terms of Service ("Terms") govern your access to and use of OutPack, including the OutPack website (outpack.app), the OutPack mobile applications for iOS and Android, and any related content, features, and services we provide (together, the "Service"). OutPack is operated by Carmur Labs Ltd, a company registered in Scotland (company name: CARMUR LABS LTD), referred to in these Terms as "Carmur Labs," "we," "us," or "our."

Please read these Terms carefully before you start to use the Service. They include important provisions that limit our liability and require you to assume risk for outdoor activities undertaken using OutPack.

1. Agreement to Terms

By accessing, browsing, registering for, downloading, installing, or otherwise using the Service (each, a "User"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Service.

Your continued access and use of the Service constitutes your ongoing acceptance of these Terms as updated from time to time. We may introduce explicit click-through acceptance in the future for material changes.

2. Eligibility and User Accounts

Eligibility: You must be at least 18 years of age to register for an account or use the Service. The Service is not intended for, and we do not knowingly collect personal data from, individuals under 18.

Registration: You agree to provide true, accurate, current, and complete information when you register, and to keep that information up to date.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials (including any password, one-time code, biometric unlock, or single sign-on session) and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security at support@outpack.app.

One Account: Unless we agree otherwise in writing, you may only operate one personal account. Accounts are personal to you and may not be sold, transferred, or shared.

3. Subscriptions, Paid Plans, and In-App Purchases

OutPack is offered with a free tier and may offer paid tiers (for example, "Pro") that unlock additional features, higher usage limits, or AI-assisted tools. Available plans, prices, billing cycles, included usage allowances, and any free trials are described at the point of purchase or in the Service.

Billing: Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) and renew automatically until cancelled. You authorise us, or the relevant app store, to charge your chosen payment method for each renewal at the then-current price. Prices may change; we will give reasonable notice before any change applies to your renewal. Where we control billing directly, we will provide renewal reminders, price-change notices, cancellation confirmations, cooling-off notices, and other subscription notices required by applicable law. For purchases through the Apple App Store or Google Play, those notices and subscription controls are generally provided through the relevant store.

Cancellation: You can cancel a subscription at any time through your account settings or, for purchases made through the Apple App Store or Google Play, through the relevant app store's subscription management. Cancellation takes effect at the end of the current paid period; you retain access until then.

Refunds: Except where required by law (including your statutory rights as a consumer in the UK and EU), payments are non-refundable. Purchases made through the Apple App Store or Google Play are governed by the refund policies of those stores; please contact the relevant store for refund requests.

Usage Limits and Quotas: Some features, including AI-assisted features, media storage, data processing, and other resource-intensive capabilities, may be subject to usage limits or quotas based on your plan. We may modify these quotas with reasonable notice. We may also throttle or suspend usage that we reasonably believe to be abusive, fraudulent, or in breach of these Terms.

4. Intellectual Property Rights

Ownership of the Service: The Service and its content, features, and functionality (including all software, source code, text, graphics, images, video, audio, design, and arrangement) are owned by Carmur Labs, our licensors, or other providers, and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. "OutPack" and the OutPack logo are trademarks of Carmur Labs.

Limited Licence to You: We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms. You may not copy, modify, reverse-engineer, decompile, frame, mirror, scrape, data-mine, or create derivative works from the Service except as permitted by mandatory law.

5. User-Generated Content (UGC)

The Service allows you to create, upload, post, share, and store content, including (without limitation) gear lists, kits, packs, trips, planned and recorded routes, GPX tracks, waypoints, timeline events, food and meal plans, macros and weights, photographs, profile information, trip reports and journals, comments, reviews, gear sentiment, ratings, and notes ("User-Generated Content" or "UGC").

You Retain Ownership of Your Content: You retain copyright and any other intellectual property rights you hold in your UGC.

Licence Grant to Carmur Labs: By submitting, posting, displaying, or transmitting UGC on or through the Service, you grant Carmur Labs a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, cache, use, copy, reproduce, process, adapt, modify, translate, publish, transmit, create derivative works from, display, and distribute that UGC solely for the purposes of operating, providing, securing, supporting, and improving the Service. We may use UGC to market or promote the Service only where you have made that UGC public, shared it with a public audience, or otherwise given us permission.

The right to modify, adapt, and create derivative works is necessary for routine operations such as creating thumbnails, transcoding, reformatting for different devices, generating preview images of routes or maps, and featuring content in compilations (e.g., "Trips of the Season"). The right to sublicense allows us to use third-party processors (such as cloud hosting and CDN providers) to store and serve your content.

For private UGC, this licence lasts only as long as necessary to provide the Service to you and ends when the UGC is deleted from our active systems, subject to reasonable backup, legal, security, and dispute resolution needs. For UGC you make public or share with others, the licence continues as needed to preserve existing shares, public pages, cached copies, backups, and references, even if you later delete the original content or close your account.

Visibility of UGC: Your UGC is private by default unless you change a visibility setting, generate a share link, invite collaborators, or post to a public surface (such as the public community feed). Once you make UGC public or share it with others, you understand that it may be viewed, copied, screenshotted, redistributed by recipients, or indexed by search engines, and we cannot guarantee its removal from third parties.

Your Representations and Warranties: You represent and warrant that: (i) you are the sole creator and owner of the UGC, or have all necessary licences, rights, consents, and permissions to grant the licence above; (ii) your UGC does not and will not infringe, violate, or misappropriate any third-party right (including any copyright, trademark, privacy right, right of publicity, or contractual right); (iii) your UGC does not contain personal data of others without their consent; and (iv) your UGC is accurate to the best of your knowledge and is not misleading in a way that could endanger another user's safety.

Content Moderation: We reserve the right, but do not have the obligation, to monitor, screen, edit, refuse, or remove any UGC at our sole discretion and at any time without notice, including for violations of these Terms or where we reasonably believe content poses a safety risk. We are not responsible for any UGC, and any reliance placed on UGC is at your own risk.

6. Acceptable Use and Prohibited Activities

You agree not to use the Service to:

  • Post or transmit any content that is unlawful under UK law, defamatory, obscene, pornographic, harassing, hateful, threatening, or that promotes violence or discrimination, including (without limitation) content relating to terrorism or child sexual abuse material (CSAM).
  • Upload or transmit content that infringes the intellectual property right of any party.
  • Engage in any activity that could disable, overburden, damage, or impair the Service, including hacking, scraping, automated data collection, or introducing malware.
  • Impersonate any person or entity, or misrepresent your affiliation or identity.
  • Engage in spamming, phishing, or fraudulent activity.
  • Use the Service, its outputs, or any content obtained from it to train artificial intelligence or machine learning models, except as expressly permitted by us in writing.
  • Use the Service to provide commercial guiding, professional planning, or paid advisory services.

Outdoor and Safety-Specific Restrictions: You must not post information you know to be dangerously inaccurate, provide advice that encourages unsafe or reckless behaviour, share routes or waypoints that cross private property without permission, or post content that encourages trespassing, entry into closed areas, illegal access, or harm to wildlife, ecosystems, or cultural sites.

7. Important Safety and Information Disclaimers

THIS SECTION IS CRITICAL. PLEASE READ IT CAREFULLY. OutPack is a planning and recording tool. It is not a guide service, navigation device, search-and-rescue service, weather service, medical service, or substitute for skill, training, judgement, official maps, or local knowledge.

Assumption of Risk for Outdoor Activities: You acknowledge that hiking, backpacking, climbing, mountaineering, ski touring, paddling, cycling, camping, and similar pursuits ("Outdoor Activities") are inherently dangerous and may result in property damage, illness, serious personal injury, or death. Risks include, without limitation:

  • Changing, severe, or unpredictable weather conditions;
  • Hypothermia, hyperthermia, dehydration, altitude illness, and other medical conditions;
  • Falls, slips, avalanches, rockfall, and hazards on uneven, dangerous, or technical terrain;
  • River crossings, water hazards, and exposure;
  • Encounters with wildlife, plants, or insects;
  • Equipment failure, malfunction, or inadequacy;
  • Becoming lost, separated from your party, or losing communication;
  • Inaccurate, incomplete, outdated, or misleading information from any source, including OutPack, third-party providers, and other users.

You voluntarily, knowingly, and expressly assume all such risks. You are solely responsible for your own judgement, decision-making, preparation, fitness, training, and skills, and for the safety of any companions or party members. You must independently verify all information with authoritative sources (for example, park authorities, land managers, official mapping agencies, professional guides, and current weather and avalanche services) before undertaking any activity informed by the Service.

Planning, Navigation, and Activity Information: Any maps, route lines, distances, elevation profiles, estimated travel times, waypoints, imported files, shared routes, itineraries, trip notes, weather or environmental information, daylight information, land-access context, gear data, pack lists, food, nutrition, hydration, barcode, product, catalogue, and recommendation information shown on or generated by the Service is for planning and reference only. It may be inaccurate, incomplete, outdated, estimated, AI-assisted, user-submitted, or supplied by third parties.

Roads, trails, paths, access rights, boundaries, permit requirements, closures, fire restrictions, terrain, weather, water sources, food availability, product labels, gear specifications, and environmental conditions can change without notice. A route, itinerary, item, product, pack list, meal plan, or recommendation shown in the Service does not mean it is safe, legal, suitable, nutritionally appropriate, allergen-free, or fit for your activity, party, equipment, skill level, health, or current conditions.

Do not rely on the Service for real-time navigation, emergency decisions, medical, dietetic, nutritional, or safety-critical decisions. You must independently verify information with authoritative sources, including official maps, land managers, park authorities, weather and avalanche services, product labels, qualified professionals where appropriate, and your own inspection, weighing, judgement, and local knowledge.

AI-Assisted Features: Some features rely on artificial intelligence, including (without limitation) features that generate, extract, classify, summarise, estimate, enrich, or recommend information from content or inputs you provide. AI-assisted outputs are probabilistic, may be wrong, incomplete, biased, unsuitable, or hallucinated, and must be reviewed by you before you rely on them. We do not warrant the accuracy, completeness, safety, legality, or fitness for purpose of AI-generated or AI-assisted content. Where AI features process content you supply, that content may be transmitted to third-party AI service providers for processing, as described in our Privacy Policy.

Reliance on UGC: Trip reports, route notes, gear reviews, gear sentiment, comments, ratings, and other UGC reflect personal opinions and experiences of individual users. Conditions change. Reliance on UGC is strictly at your own risk.

8. Disclaimers of Warranties

"As Is" / "As Available": To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, or arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, timely, secure, or free from errors, viruses, or other harmful components, or that any data or content will be accurate, current, or complete.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, our disclaimers apply to the maximum extent permitted by law.

9. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

Subject to the paragraph above, to the fullest extent permitted by law, in no event will Carmur Labs, our affiliates, or our respective licensors, service providers, employees, agents, officers, or directors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Service, your participation in any Outdoor Activity, or your reliance on any information made available through the Service, whether based on contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Subject to the first paragraph of this section, our total cumulative liability to you for all claims arising out of or in connection with the Service or these Terms shall not exceed the greater of (a) one hundred pounds sterling (£100.00) or (b) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Carmur Labs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (i) your violation of these Terms; (ii) your violation of any law or third-party right; (iii) your UGC; (iv) your misuse of the Service; or (v) your participation in any Outdoor Activity, including any injury, loss, or damage you cause to another person or property, except to the extent caused by our negligence, breach of these Terms, or unlawful act.

11. Third-Party Services and Affiliate Links

The Service may include links to or integrate data and content from third-party services (including, for example, mapping and routing providers, weather providers, food and barcode databases, AI providers, and analytics providers). We are not responsible for the content, terms, privacy practices, or availability of third-party services. Your use of those services is governed by their own terms and policies. See our Privacy Policy for details on what data may be shared with these providers.

The Service may also contain affiliate links. If you click an affiliate link and make a qualifying purchase, we may receive a commission at no additional cost to you.

12. Copyright Complaints and Takedown Policy

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please send a notice to support@outpack.app containing:

  • A physical or electronic signature of a person authorised to act on behalf of the owner of the copyright that has been allegedly infringed.
  • Identification of the works or materials being infringed.
  • Identification of the material claimed to be infringing, with sufficient detail (such as URLs) for us to locate it.
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in your notification is true and accurate, and that you are the owner or are authorised to act on behalf of the owner of the copyright.

13. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including (without limitation) breach of these Terms, suspected fraud, abuse, or risk to the safety of other users. You may terminate your account at any time through your account settings, or by contacting support@outpack.app. Provisions which by their nature should survive termination (including UGC licence grants for content you have made public, disclaimers, limitation of liability, and indemnities) will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date at the top of this page and, where the changes are material, we will provide reasonable additional notice (for example, by email or an in-Service notice). Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.

15. Apple App Store and Google Play Provisions

If you obtained the OutPack mobile application from the Apple App Store or Google Play, the following additional terms apply, and prevail over inconsistent provisions of these Terms only to the extent of any inconsistency:

Acknowledgement: These Terms are between you and Carmur Labs only, and not with Apple Inc. or Google LLC. Carmur Labs (and not Apple or Google) is solely responsible for the OutPack application and its content.

Scope of Licence: Your licence to use the OutPack iOS application is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms (including the Usage Rules). On Android, your licence is governed by the Google Play Terms of Service in addition to these Terms.

Maintenance and Support: Carmur Labs is solely responsible for any maintenance and support for the OutPack mobile application as required by law. Apple and Google have no obligation to provide maintenance or support.

Warranty: In the event of any failure of the OutPack iOS application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the iOS application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the iOS application.

Product Claims: Carmur Labs, not Apple or Google, is responsible for addressing any claims relating to the OutPack mobile application, including (i) product liability claims, (ii) any claim that the application fails to conform to applicable legal or regulatory requirements, and (iii) claims arising under consumer protection or similar legislation.

Intellectual Property Claims: If a third party claims that the OutPack mobile application, or your possession or use of it, infringes that third party's intellectual property rights, Carmur Labs, not Apple or Google, is solely responsible for investigating, defending, settling, and discharging that claim.

Legal Compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms: You must comply with applicable third-party terms when using the OutPack mobile application, including any app store, wireless-data, mapping, routing, weather, or other service terms that apply to features you use.

Third-Party Beneficiary: You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the OutPack iOS application, and that Apple has the right to enforce these Terms against you as such.

16. Governing Law and Dispute Resolution

Governing Law: These Terms and any non-contractual obligations or disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Scotland.

Jurisdiction: You irrevocably agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms. Nothing in this section limits any mandatory consumer protection rights you have to bring proceedings in the courts of the country in which you reside.

17. General

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Carmur Labs concerning the Service and supersede any prior agreements on the same subject matter.

Severability: If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law.
